     On November 12, 2013, in a case, probably not noted by many people, the West Virginia Supreme Court of Appeals did away with the "open and obvious doctrine in premises liability negligence actions."  The case was Hersh v. E-T Enterprises.  The 'open and obvious' doctrine had existed in West Virginia since 1902, and, generally, stood for the proposition that if a hazard on another's property was open and obvious to a reasonable man, than a visitor to that p...

Too Many Lawsuits?

I was all set to sit down and write a nice little, innocuous blog post reflecting on the ATV editorial that was in the April 15, 2015 edition of The Journal.  It is a rare thing, but I finally found myself in agreement with The Journal.  In a nutshell:  ATVs are wonderful machines, but if they are not operated properly, they will maim and kill.  The Journal then went on to urge all ATV riders to be safe.  I couldn't agree more.

Sunday Morning

     Last night I wrote what I thought was a great blog.  It was intellectual, sensitive, almost poetic in its language.  The blog discussed my thoughts on electing our supreme court.  Simply put, I am opposed to it.  With the first two branches of government awash with the poison of money, I think that we need to keep at least the third branch free of undue influence.  America is a republican democracy.  As such we don't let the mob make laws, we ...

     Let me get this off of my chest.  I am a democrat, with a capital D!  Maybe, once long ago, I might have been a republican.  When Lincoln was a republican he represented the party of the little man, he was for a relatively strong Federal government that would work to protect the rights of the disenfranchised, the uninitiated, the poor.  Lincoln objected to the aristocratic leanings of the old world, where family money would pass unencumbered from genera...
